i filed a return form a new tax guy back in march,he said i was all set and to mail it in ,,so i mailed it when i got home and read it,, i noticed he put a bunch of false information,,so i then called a taxman that my parents go through.. i had him redo my taxes and send it directly through the internet the irs recieved his first,, before the guy that had me mail it,,they should of rejected the mailed one since the saw a different date on the one that reached first,,but they sent me a return in april ,,,then i got a reutrn in august from the first guy ,,am i in trouble,, i thought i fixed it so i dont get in trouble,,what do i do??

If I understand your question correctly, you filed 2 different tax returns and got 2 refunds. Look at both returns, make sure the 2nd one isn’t a 1040X amended return. If it isn’t a 1040X make sure they both have the same SSN and name. It is very unusual for IRS to send a refund for 2 returns on the same year and SSN, unless it is an amended return. When this happens without an amended return they call it a duplicate return and freeze the refund until the taxpayer contacts them to tell them which return is the one that is supposed to be processed.

If there is go there with both returns, tell them the story and they will help you sort it out.

Call the IRS at 800-829-1040; pick the options for a tax law question. Tell the call screener you want a transcript. When the assistor comes on the line tell them the story and request a transcript called a Record of Account. You might want to call from the preparer’s office that does your parents returns so he can translate taxeese for you.

If it turns out you owe money they will work out a payment plan for you. If it turns out to be small enough you can pay in 4 month or less ask for an extension (free). If you can’t pay in 4 month ask for an installment agreement ($105 fee).

If you knew the one that the first guy prepared had false info, why in the world did you mail it? You did the correct thing by going to the other preparer and having him or her do a correct return - that should have been the only one sent.

If what you're saying is that you mailed the bad one also, so two returns were filed, and you got the higher refund or both refunds, your best bet would be either to call the IRS, or even better to stop in at one of their offices near you, take along the copies of both returns, and explain to them what happened.

If you cashed the check and spent it from the falsified return, then you're in a little bit of trouble - you aren't going to jail or anything like that, but will have to come up with the money to pay it back. If you didn't cash the check that you were not entitled to, then just take it with you to the IRS and give it back to them, and you should be OK.

If both returns had the same social security number on them for you, the second one they received should have been rejected - sounds like either one of the ss# was incorrect, or their computer that checks for duplicate returns wasn't working right that day.

Return the refund check, or the amount of the refund check, from the first return. Do it right away, since you know that it is wrong and you also filed electronically.

The return that was sent electronically could not have been an amended return, since those have to be mailed.

I am surprised that the mailed in returns were not cross-checked immedicately with the e-filed returns, but since they were so close in time, obviously what happened is that they were both processed and you got two refund checks. The IRS will eventually catch this and demand the return of the "wrong" refund..
