and included in the check is some money for our daughter (dependant pay) we are seperated and he wont pay child support is there any way i can get this extra money taken away... not even necessarily given to me but if he dont support her he doesnt deserve it

As a vet who receives disability, I hope you follow up as directed above. Anyone who served his country deserves help with his family but if he is no longer taking care of his family he no longer deserves the help. Good luck to you.

If you have his ssn, you can contact the VA. Tell them the situation and the VA will launch an investigion. Then if they find the dependent is no longer in his care then they will take away that dependent pay and he may end up paying back the pay he had already received for that dependent. They will try to get the last day the dependent was under his care. Contact your local VA, DAV, or County Veterans Advocates.

Chances are you are not going to get any of it until there is a finalized divorce and a court order for child support. A separation does not mean anything to the VA. As far as they are concerned, you are still married. What is his disability rating? If you know that percentage number, you can find out how much he gets for dependants. By the way, he also gets money for "you", as long as you are still legally married.

you need a court order specifying exactly what he is to be paying in child support.
