It was midday and there was alot of traffic driving right past us, isn't that dangerous? Should it be illegal? The officer just stood at the back of the car while my husband had to get out amidst of all the traffic, endangering himself. It was only a moving traffic violation (speeding).

Actually, it is legal, however, without being there with the officer to see or understand his actions makes it difficult to answer why he may have had your husband exit the vehicle.

Several years ago a case of this nature was presented to the Supreme Court where the court affirmed the actions of the officers being able to order an individual from the vehicle.

It may have been safer had he directed your husband to exit from the passenger side since you were on a highway!

On a side note....many states are adopting what is referred to as the "Move Over" law meaning anytime the police, fire, medical, or tow services are engaged in activities on the side of a roadway, drivers are required to move to the next lane of traffic of if unsafe to do so....slow down considerably to a safe and prudent speed while passing the vehicles on the side.

Interstate 20 in LA is a real bad place to travel, drug smugglers and at onetime they had a man traveling that Interstate and a woman was in danger to travel by themselves. He was pulling the women over and telling them something was wrong with their car he would grab them put them in his car and had more women murdered on those side roads than any other interstate. Maybe he is giving you a chance to let him know if this is happening again , because it really got bad and dangerous on La 1- 20

It is dangerous, but I believe it's also a requirement. Handing out a speeding ticket is a confrontation, and police officers are often met with people who don't react well to confrontation, even if it is just a speeding ticket. So, they're asked to get out of the car, just in case the driver isn't packing a gun.

its not dangerous...the cop wanted to get you out of the car and away from traffic....there is a video of a silver sunfire getting rear ended on a traffic stopa dn the trooper had the women on the shoulder...the speed was like 70 mph...she would have died if that trooper didn't have her out of her car...and it was JUST a speeding ticket....so if anything you should say thank you for allowing me to get out of my car and on the shoulder...

Funny, but this only happens to people who are breaking the law. Of COURSE it's dangerous, but it is completely legal, and hopefully it bothered your hubby enough that he will obey the traffic laws in future!
