why is it wrong... the snipers in iraq are being charged with crimes by simply placing items that will be used by the enemy. all wars work the same, we used to place gernades on things they would use and it worked,, we are selves were thought don't pick up nothing you were not issued for the same reason.. works both ways i think.. need a yes or a no if they should get charged.. ( it's freaking war folks)

No! We have to many cowards running this country and this war! The tactics the snipers are using now have been used since WW2. War isn't pretty, people! Keep the cowards losers in our government out of war and let our fighting men and women do their jobs! If you haven't been to war yourself, keep your nose out of it!

Well actually, them being snipers, had nothing to do with this case at all.

This case, the first trial was a soldier who was ordered to shoot an Iraqi at close range with his sidearm.

They then tried to cover up the shooting, by making it looked like the Iraqi was armed.

The soldier in question was acquitted.

But the trial of the SSGT who ordered him to shoot the unarmed Iraqi, is still to come.

That trial will be contentious too.

Since they were in a sniper hide, and being found, would put their life in direct danger.

It will go back to the age old question, when behind the lines, just what actions can you take, to maintain security.

Some would see the killing of an unarmed man, as murder, but to let him go, would have endangered the lives of the snipers. Plus the fact, just why was the man there ?

It is definately not open and shut case, and could have ramifications far beyond, just this single issue.

So, if you were walking and saw a gun in the road, would you pick it up and/or call the police? Or leave it there for some kid to pick up and possibly take to school?

I don't agree with the 'baiting' of people by leaving dangerous items out in the open just in case a bad guy comes strolling along and decides that it might be of value to him.

I have to wonder how many truly innocent people were sniped by this method.

If the orders came from a superior to use this method, then the superior should be charged with the crime. If the sniper baited the people without orders to do so, then they should be charged.

War is hell.

It's a shame that when our military does develop effective tactics to use against a shadowy enemy, they're criticized for doing so.

This war, like so many of the wars of this century, will not be traditional in any sense. We don't have a "front," and don't even know who our enemy is or from where he's getting support (though we have good suspicions). If there ever was a time for ingenuity and out-of-the-box thinking, the time is now.

I say we shouldn't charge them. If it turns out their actions are crimes according to the Geneva conventions, then we might consider charging their superiors who gave the orders.

The Military uses the Army CID and the Navy NCIS to investigate all of those charges and see if they fall under punishment in the UCMJ, either directly of via ROE's given or Orders given. The victims of the crimes get more than a fair representation, it is usually the guys accused that do not. They are second guessed by others who were not on the ground at the time, who have never been in or have not even been trained enough in combat to give opinions and the press is not exactly easy on the men accussed either. Bad Judgment will not usually get it done on court as long as the Jury is peers who have seen combat, they will almost always err on the side of the one who did the shooting since they know that re-action is always slower than action and it is hard to judge someone for a split second choice made under fire and stress.

It's wrong because you can't prove any intent that the person picking up an object, like a detonation cord, intends to use it against the US. What if the person doesn't know what it is? How can you be 100% certain they will use it? There are no answers to those questions, and if people lose their lives over such a simple mistake it's entirely wrong. We are fighting FOR Iraq, but killing their people won't help the mission.

Yes, they should get charged but these trials will be difficult. A lot of 'frame of mind' situations need to be considered, as well as specific orders. Witnesses against the US are questionable, as are witnesses for the US.

It seems pretty straightforward to me. Just because somebody picks up a length of det cord doesn't make him an insurgent. If I found some in my front yard, I'd pick it up and dispose of it. There's nothing innately wrong with baiting, but especially in counterinsurgency operations in which it's more important to generate a partnership between the local population and the troops than it is to kill some bad guys, a little common sense is required. Even a private soldier has to look at a larger picture than just the sight picture in his rifle's scope.

THE WAR IT SELF IS WRONG AND ILLEGAL, what are you people talking about it. War is not a TV program or commercial. Get back to wars reality people. You know who is dying in wars, women and children, the weakest.
That is what we came to, macho humanity. How can you people be so ingnorant about the reality.
