He couldn't. It's another contradiction, and proof that the bible is mostly opinion.

I. The Particular Judgment (from the Catechism Of The Catholic Church):

CCC 1021 - Death puts an end to human life as the time open to either accepting or rejecting the divine grace manifested in Christ. The New Testament speaks of judgment primarily in its aspect of the final encounter with Christ in his second coming, but also repeatedly affirms that each will be rewarded immediately after death in accordance with his works and faith. The parable of the poor man Lazarus and the words of Christ on the cross to the good thief, as well as other New Testament texts speak of a final destiny of the soul—a destiny which can be different for some and for others.

CCC 1022 - Each man receives his eternal retribution in his immortal soul at the very moment of his death, in a particular judgment that refers his life to Christ: either entrance into the blessedness of heaven—through a purification or immediately, — or immediate and everlasting damnation.

When you die, its either Heaven or Hell. There is no sleep or soul sleep. Jesus's Parable about the rich man and Lazarus made that clear, Paul said to be absent from the body is to be present with the Lord.2 Cor. 5:8. The word there can mean also rest. What did God tell moses or aaron when they were doing to die, or daniel. In Daniel, 12:13, But go thou thy way till the end be: for thou shalt rest, and stand in thy lot at the end of the days. Every person who died during the old testament covenant went to Abrahams bosom or Paradise. It was inside the earth somewhere, they had not ascended to the third Heaven with God because they needed a Perfect sacrifice of blood to atone for there sins. In Hebrews 9:22 it talks about the sheding of blood and without it there is no remission for sins. Jesus, because he was sinless, washed away our sins on the cross, When he gave up the ghost on calvery the Bible says even some of the saints stopped off at Jerusalem on their way to Heaven with Jesus. Jesus emptied out Abrahams Paradise and now when we die if we are a born again Christian we go straight to the third Heaven to be with Jesus. Oh what a glorious day it will be. If you are a Christian you are ready, if not and you would like to more about Jesus I would be glad to talk more about my Saviour, good luck and God Bless. Numbers 6: 24-26

The only ones I know of that do not come to life after death, until the judgment are those who die during the tribulation wp are not believers in God. Rev 20:5 The rest of the dead did not come to life until the thousand years were completed. This is the first resurrection. So the spirits of OT people were conscious in Hades.

who says they are sleeping? that doesn't make sense. oh wait i know who....

He preached unto the spirits in prison to give those the chance that had never heard His gospel the chance to accept it. that work still goes on today and that is why baptisms are done for the dead by the Mormons. so the dead have the chance to accept the ordinances as well if they want to.

He spoke to the demons who were cast out of heaven and in spiritual darkness as a judgment that the prophecies concerning him were fulfilled.

Don't question the Word of God in this way. Just accept it and move on...doubt comes from the enemy.
