Ok,the way got into the U.S was on the VWP.. but I arrived in the USA with my U.S citizen husband and our 9 month old son who was born in the UK,and some people on here are rather harsh,I never did anything illegal whilst I lived in the U.S I didnt work illegally,I only worked with a valid work permit,and I paid Taxes during my almost 5 years in the USA.. So its not like a came into the country un-inspected by an immigration officer. I do understand there are rules,I get that I do,and I love america for those because it keeps everyone safe,however I am no threat to america or its citizens,I`m just a spouse of an american citizen and a mother of a soon to be U.S citizen who just wants to get back with her family as soon as possible,I had no idea that the goverment would keep a family apart.

I'm sorry if we are coming across harsh. I think it's more a case of being blunt for most of us. I'd love to say everything is going to be just fine, but that probably isn't going to be the case and my sugar coating the facts aren't going to help you. I know you don't think you've done something awful by leaving out of status...and in fact you have NOT done anything illegal...however, the consequence of leaving out of status is that you can longer re-enter. It's just a fact of life.

The very best advice I can give you is to get a good immigration attorney. They may be able to get you over on some sort of a hardship exception, but I doubt very much that you will be able to stay.

They process spousal visas pretty quickly. Just hang in there.
