i my ex got me this car when we were together.innocently, i thought adding my name to it would really make it mine! so we had both names as Owners ( NOT one person AS A COSIGNER).my name was first cos i got better credit than him. well when we broke up, he said i should voluntary ask our creditor to reposses the car. i did not want to mess up my credit so i kept on with all the payments by myself for about 9 months without a late payment. then my ex called me up and said he will take the car and make the payments and i will only be responsible for the insurance. i thought it would be a relief not paying over $500 a month!!! about 3 months after he had the car i got a call from the car company saying our account has been on default for 2 months....i called him up and he said he can't afford the car and i will need to take it for a couple of months.then he said i should lend him some money to pay off the late payments. i said no.

he called me up later and says he is going to keep the car for another two months before he gives it to me. our payments are going to keep being late and it is messing up my credit too. what can i do about this?

i suggested he refinances the car since he keeps getting those mail that are offering him lower rates but he said no. and that if he does and can't make the payments then he alone will be screwed! well, i know he won't make the payments and i am ready to give the car up but he claims he doesn't want to mess up his credit.....since he as had the car, the power locks don't work, the seats are so dirty and i am afraid he will mess the car up more. is there a way i can get out of this issue? please help!
i can'r refinance cos i am taking an overload at school right now and i do not work.

i need to get rid of the car because, we are not only going to owe 4-months worth of late payments but also we will have to pay for the balance after the car has been repossed and sold. and i am certain he will not pay for any of these charges......i am so confused. i do not even know where he lives and our lender cannot help me out with this, they don't even has his physical address. i don't want to be in debt and have a bad credit. i have credit cards that i pay the balances in full at the end of each billing period so i have never had to pay any interests....this is killing me!

It seems to me that your goal is this:

(1) Completely separate your life and finances from your ex's. You are more responsible than he is. This will only continue to create problems. Sharing a car with him? No! Stop the madness!

(2) Evaluate whatever harm your ex's actions have done to your credit rating and finances and make a plan for getting back to where you were.

In order to do the above, you will need a lawyer's help. Legal Aid might be a good place to go for help. They'll have income guidelines, but if you don't meet them they might be able to recommend a low-cost lawyer.

Seriously. Separate yourself from this guy, legally and financially as well as dating-wise.

Don't let this slip. And be glad you didn't marry him.

The problem is that you are co-x on acct. Creditors are probably looking for car to repo it if the acct is over 60 days past due. Sounds like you cant afford a lawyer so you need to contact creditor asap because this is affecting you credit. Tell them the situation and ask them what you will have to pay if they repo it. legally you will have 10-days to redeem car after it is repoed. They may let you pay the account up to date and redeem car. If they wont let you just pay it up to date or if they demand payoff, DO NOT tell them where car is. Just find out how much $ account is past due and go pay that amount. Then you must get car back. If you have a spare set of keys, just get a ride to car and then leave in it. Keep a copy of title to the car with you. If you dont have one you can get one from creditor that has lein on car. I would notify local police of the situation just in case they can assist you with getting car back. Let this be a lesson about cox w/other people

Your credit is ruined and it may take years to recover. I would think about getting the property back and sue in court for your money back. Keep all the records you will need them. So much for that relationship. You were to nice even paying his insurance while he was not living up to his side of the bargan. As for deadbeat take the car away and do not let him have it back sell it get what you can move on Girl.

Record a conversation about the car and take him to small claims court. Or call the people who you brought the car from and let them here the conversation. Ask them to repo it and let you pay them back what you owe and take his name of the contract. Good luck

Lady you need a lawyer real fast.
Did you know that in some states such an action is marriage?
You might have to file for a divorce some place along the way.
