my friend has not paid the fine for his ticket in Orange County, CA. He went to court and the court clerk told him they could not take his payment for being too late (2 months behind) and that he needed to see a judge. He also got a notice from the court notifiying him there was a civilp-assesment of $300 added to his initial fine of $356 and that the only way to avoid it was to pay the initial fine in full.

I agree with all of you, that's why I made it clear it was a friend of mine, cuz I have had several tickets and taken care of all of them. I don't understand why people don't take care of this things on a timely manner. His case is really stupid, he received 2 extensions, and in the last one he ended up making payment arrangements ($50/mo.) His problem is that he was unemployed for 7 months and only now was he able to make a payment. Yeah, he has friends that have been helping him out, but to certain extent. He needs to learn his lesson, I told him I wouldn't help him with his fine, get a job first! I also told him to go and see the judge to explain the situation, but I guess he assumed the judge wouldn't care. I told him it was better to show you interest in working things out than to just disappear.

I still didn't understand, does a DMV-HOLD mean his license is now SUSPENDED? If it is not suspended, what could happen if he gets pulled over?

A DMV-hold is not the same as a suspended license and does not mean his license is now suspended. If he gets pulled over, the Officer may recommend that he promptly present his attendance at the nearest DMV or a local court within OC. If he fails to comply with neither then the *DMV* will *hold* his license/registration renewal. Without a renewed license/registration he will be unable to continue driving, and thereafter will not get pulled over. For if he did, he would soon find himself facing new charges.

This civil assessment for failure to pay/appear is NOT a warrant of arrest. Obviously, sean t has not read California Penal Code section, 1214.1, subdivision (c).

may need to get an attorney -

I think your friend got a letter saying that IF they did not pay the initial fine - the assessment would be added -

since the clerk's office will not accept the fine now - that offer has probably been rescinded and friend will need to get butt down before a judge in humble attire

may even have a trooper stopping by to pick up their license -

Your friend needs to see the judge. A DMV hold as you put it and did not elaborate means they promised to appear and didn't (I.E.) warrant of arrest. Civil assesments are additional fines. Go see the judge... O.C. resident. been there done that!

No doubt he has a warrant for arrest. Contact DMV to see what the hold is, they will tell him. If he's pulled over he's going downtown. Judges dont take failure to appear very lightly

What was written in your notice of cancellation? People usually know why their license is taken away. What did DMV telll you?

I get so annoyed with these questions.

Yeah - judges DO tend to get annoyed when you don't obey their orders!

It isn't rocket science. Pay the danged fine.

WRONG ... driving is a RIGHT not a PRIVLIGE ....we need to fire all the cops and outsource a security firm . just like we did with CIA.

Cops are not meetig our needs. This land belons to us. This land does not belong to cops and we should not be fined for minor ticket infractions. I'm ready to see them fired and ourstourced. How do others (non police) see this > We did not have police generations ago and it seemed to work fine.
