I got a ticket 18 months ago, well 19 days shy of it. I went to traffic school for the last ticket, and went to traffic court and the judge said I can go to traffic school 1 since it was so close. Will my insurace still go up since it was so close to 18 months they court said it should but wasnt sure? I live in CA.

Actually, there is no limitation upon the number of times the court can allow you to go to traffic school and get a ticket dismissed, which saves a point for DMV purposes. If the second ticket is within 12 months of the first, a 12 hour school is required. (Veh. Code sec. 41501.) However, every such dismissal is reported to DMV (Veh. Code section 1803.5), and only one such dismissal in any 18-month period is confidential. (Veh. Code sec. 1808.7.) In other words, you can get the dismissal, but your insurance company still knows about it.

The language of section 1808.7 appears to indicate that the 18-month period is measured from dismissal to dismissal, not citation to citation (although VC 41501 is clearly citation to citation), but I do not have any information on how DMV actually interprets section 1808.7. My guess would be citation to citation, but my best advice in this posture would be to make sure that the second dismissal happens over 18 months after the first one, and then see what happens.

Your insurance DOES NOT CARE what the court says. They follow their owe rules based on the fact you were issued the ticket. ONLY your insurance company can answer this question.
