Yes it can be. That is why you are supposed to take it in cycles. 6-8 weeks on, 6-8 weeks off. But that's about the only thing you need to look out for, other than that, it's perfectly fine to use. Just be sure to drink alot of water.

Not at all. Anyone who says this is uneducated on how human physiology works. It would only be potentially harmful to kidney patients.
Medically, creatine is a substance found naturally in the body. In kidney patients, elevated levels of creatinine can be found. In someone who is taking creatine as a supplement, especially with extra proteins (say, bodybuilders for instance) will also have elevated creatinine in the body. The difference is that the healthy person can handle it. Unfortunately, some people, even some doctors not up with sports nutrition, find a correlation between the two and hence are alarmed. Research has shown numerous times that this is simply false and unless someone has predisposed kidney problems it will not be an issue.
Here is a decent article on this subject for more details. Though it's geared toward concerned parents, it goes over the basic facts about protein and creatine intake:

And another FAQ article about creatine, including health questions:

for those that have healthy kidneys there is no issue with creatine. people with unhealthy kidneys have to limit the intake of many foods and supplements.
creatine is the most studied nutritional supplement and has been for over 30 years.

Nobody really knows. The problem is that scientists haven't studied it much. It certainly isn't recommeded for people with liver problems or who take drugs, such as Tylenol, that have an affect on the liver.
I found a link that has some good explanations.
