Depends.

Are you done treating? - If not, you can't settle until treatment is complete. Then insurance company gets copies of your medical bills/records. If no attny, they have you sign a medical auth and they order them. If you have an attny - then your attny orders. It can easily take 4-6 weeks for medical bills to be received. Once the insurance company gets the records - they review them. Then they make an offer. Once you and the ins co have reached an agreement on the settlement amount, then you (and your spouse if you are married) have to sign a release and they send you the check.

AD summed it up perfectly. I would add that once the complete medical records are received it can take up to 30 days for adj review. Depending on how serious the injury and the amount of med records

Depends on how good their attorney is at stalling .

Call the insurance company daily , very polite but sobbing and inquire as to when you claim will be processed and mailed .

If there was no insurance , you may have to put a lien against the property after going to court .
You would get settlement if and when they sell the place .

Depends on the neighbor and their financial ability to pay. Sometimes you have to return to court to draft their account if they are the fiesty type, sometimes never if they are the bankrupt type.
