He should, that's his negligence so he should pay for it, much more if he did it intentionally (let's hope not, but it happens). A person should pay for the damage he caused to another whether intentional or not..

If you were to sue you would get the depreciated value of the item, that is, you would not get a brand new laptop to replace one that is 3 years old, because then you would be in better shape than you were before. They would have the responsibility to make you whole.

Short answer - you should be compensated for the fair value of the lost laptop.

Someone should never barrow something unless they are willing to pay for it, if they loose or brake what they've barrowed in the 1st place.

My mother always taught us to treat other peoples things as though it were our own, In other words with the same respect.
Treat it nicely & return it in the smae shape that it was in, when barrowed.

If it can't be returned in that same shape, buy a new one & return it in better shape.

He should replace it with like kind and quality. In other words, if it is a 3 year old 1 gig HP, he should replace it with a similar one. You are not entitled to a new Dell 3 gig replacement.

Yes they should pay you back, and yes if they dont you can take them to court.
