The council have marked out my neighbours disabled bay to lap 3/4 over outside my property (we live in terrace houses), so in effect, I cant park out side my own house. Can the council do this without my permission?
I have called them to object and to put the bay back the way it was before the road was resurfaced. Also, this bay has been marked, at a guess about 15 + ft, a massive increase to the original bay.

Keep complaining they will redo it as it is an oversite on their part. But remember that roads are public right of way we don't own them unless yours is different?

Write a letter of complaint then see that they have recived it they will have ten days to reply by law. chase them up that the director of manager of the deptment got the letter.

If the bay is marked out on the road as opposed to some kinda of paving outside the property then I think it's the councils decision and there's not much you can do, because they're responsible for the road so I think they can put bays where there is a need for them, sorry. Keep calling and writing to object though and mention you also have a need for parking by your property as it doesn't sound fair that help for someone else with a need for a bay has come at the cost of your right to park there too.

That is a huge bay! Cant say I've seen one that big! I read that the standard is 6.6m x 2.2m. So it seems its slightly Excessive.
What car do they drive??
Its a little unfair if it was previously outside their house and now they've extended it after re-tarmacking.
Have they changed cars or have a larger vehicle?
Best you get on to the council, the terraced house roads round my way is nightmare to park, so extra large bays don't help, there are the other residents they should consider too. Good luck x

You do not actually own the road so it is quite legal. Suggest you complain to the council but I would n ot be at all suprised if they suddenly found that it was dangerous to park your car outside your front door and banned it ffor everyone except your disabled neighbour. So query rather than demand. Councils do not believe in democracy unless it is a way of charging you more

YOU HAVE NO PARKING RIGHTS ON A PUBLIC ROAD,EVEN IN FRONT OF YOUR HOUSE,YOU MAY COMPLAIN TO THE COUNCIL OF COURSE,INDICTING THE ROAD MARKING PAINTERS HAVE PUT THIS BAY IN THE WRONG POSITION,AND IT SHOULD BE OUTSIDE THE DISABLED PERSONS HOUSE AS IT IS CAUSING THEM MORE DISCOMFORT.TALK TO THE DISABLED PERSON ABOUT IT,I BET ITS HAPPENED BECAUSE THE PARKING BAY PAINTERS STARTED FROM THE END OF THE ROAD,WHEN THEY SHOULD HAVE PUT THE DISABLED BAY OUTSIDE HIS HOUSE AND WORKED BOTHS WAYS FROM IT.If it is a stand alone bay they have to make it big enough for the disabled person to get into it.Think of him,its no fun being disabled.Any vehicle parked next to this space should be aware that your vehicle bodywork,or no part of your vehicle, must overhang the lines at the bay ends, you will be towed away immediately.

You don't have the right to park outside your house. In fact you don't have the right to park ANYWHERE on a road.

The only thing you have the right to do on a road is to pass along it (right of way) - and even THEN only on foot. Anything else you're allowed to do on a road is a privilege, not a right.

It could be because the disabled person has to have a bay for a larger vehicle, to allow for loading and unloading a wheelchair.

I have neighbours like that but you dont own the road so anyone can park on it.What they cannot do is obstruct your drive but as you are terraced you dont have a leg to stand on.

Yes - they own the road and can do with it what they will. It is not your road and you have no right to park there over and above the common right of all persons who pay their road fund tax.
