I called the treasury dept in my state, but since he had remarried 2 months before his sudden death with no will, they say his widow has the right to claim. Me and my sister got nothing from his estate. How should I go about convincing his widow to sign over rights to me and my sister. We are not talking about a fortune, it is less that $1,000. We just want it closed out.

P.S. This woman gave us nothing of my fathers after his death for even sentimental value. ( except his families photos).

Well, hon.. first of all don't blame the step mother for your father's choices.

He didn't have a Will, and that was his choice.. he married her, and that was his choice... So, it's your father's doing that you got nothing when he died... not his widow's.

Please look at this as it really is (even if your step mother is a b|tch).

You can ask the woman about signing over the stocks... that's my best answer.

Short of hiring a lawyer there's probably nothing you can do. Hiring a lawyer would cost you more then you would get in return.
Since he married this woman I don't see why you would think that the money is rightfully yours. If there are other personal items that you think you might want of your dad's then it would be certainly fine to ask for them.

P.S. You have no idea what bills your step-mother and father shared.. both before their marriage or during. You don't have a right to demand money.

unfortunately without a will..you really have no "legal"leg to stand on BUT their is amoral question here..tell this woman that your Father wanted You to have this stock..is there anyway she could change her mind?that is about all you can do
