So it's the fault of the object that was just lying there? Not moving...just sitting there......so, how many other cars were able to avoid the object. What did they do that you did not do?
You are negligent for:
1. not maintain a proper lookout and not seeing what you ought to have seen. Drivers are supposed to be on the lookout for debris, potholes and other hazards on the road way.
2. traveling too fast for road conditions
3. failing to maintain control of your vehicle
Your insurance policy has language in it that says your insurance company has the right to pay, deny, defend claims as they deem appropriate. You can't make them pay or not pay the claim.
It is actually in your interest for your insurance company to pay the other guy. If they were to deny him, he would sue and he would win in court. It is better for you if your insurance company establishes a good relationship with the other driver from the beginning and works to settle with him. Less likely he'll sue and they may be able to get the claim settled for less than what a jury would give him.
Suck it up - you're at fault and your insurance company is doing the right thing by paying for the other guys car.

Well.....whose fault IS it? The 'something' on the freeway? Do you think it has liability coverage? Wake up. Your insurance company isn't trying to 'pin' anything on you. There is no way you are not going to not be found at fault for crashing into another vehicle. You hit something, you lost control, then you crashed. BFD. Just be thankful you have insurance.

There is a police report. What does it say?
If it states there was a '____________" in the road that you hit causing you to lose control of your vehicle then there is nothing the insurance company can say.
You can obtain a copy of the police report at the police department or Highway Patrol which ever investigated the accident.
Hope this helps.
Oh BTW the police report does not state a 'fault'. It is just the facts.

no offense, but it was your fault. you are the one who cause the accident. about the only thing you could do is try to find out what it was that you hit, find out where it came from, and sue that person for the damages.

Sorry but your chance of winning are very slim. You were not payng attention and failed to maintain control of your vehicle. That's their angle and I hate to admit they are right.

What does the police report say? If they stated it was your fault I'm not sure you can fight it..If the police have stated it was not your fault I'd fight it..Good Luck
