Well, legally, you'll have to marry the guy, then have him adopt the kids, and by the way, you'll need the Father's consent. This will have to be done in family court. Your BF can start by helping you to change your last name to his through marriage.

In the old days, before anyone cared about birth certs and SSN cards, a child changed their last name on the marriage of the mother to a new man. In some cases, the child may never have known until they needed a birth cert later in life.

Anyways, you're on the genealogy forum and this is the wrong place for your questions anyways, try retyping it the children and family law section.

You'll have to go through the court system to change the children's last names. Go to the courthouse in your area and ask them. They'll be able to give you the forms that you need and set a date for a hearing in front of a judge to change the names.

You need to consult an attorney and petition the court for a name change. You have to show the judge that it is good for the children and not harmful to anyone else.

You have to petition the courts to allow him to legally adopt the children. A family law lawyer can help you with the adoption

apocalyptic_poptarts is right - unless you want to do this every 2 - 3 years, wait until he offers to marry you. If he doesn't offer, he is keeping his options open, which means in a couple of years he will go with someone younger, prettier or just a bigger bra size.

Just start using his last name. And when they are old enough they will use it. This is America, you can go by any name you desire. My wife's son has and is, and he's 25.
