I am being charged with Home Invasion, 1st Degree, 4th Obitual in Lansing, Mi. My record is 2 Larcenys from a building at the same time in 2003, and a Breaking and entering vehicle in 2004. Right now i am on probation for disorderly conduct but i have been one of my probation officers best probationers. I am in school for political science as well. What are my chances for sentencing? 1st degree carries a 15 yr max term in prison and/or $5000 fine. 2nd degree is 10 yr and/or $3000 fine. and 3rd degree is 5yr prison or county jail time i think and/or $2000 fine. what are my chances of getting a fine and county time? what type of pleas do you think they may offer or should i suggest to my lawyer? is joining the army and paying a fine an option? And the only evidence against me is a eye witness who identified me by a tattoo on my neck, and what i was wearing. I was not arrested on site. Would laser removal of this tattoo help my case? Im only 23 years old and i dont have a juvenile record.

I am a student at MSU and I walked into someones house thinking there was a party going on. I didnt steal anything. It was simply being in the house without permission because I was so drunk. I didnt commit the Breaking and Entering..a friend of mine did and I took the rap. The 2 larcenys came from my first year when i took a pc monitor from the library.

I am not a bad person or a big criminal...yes i did take the monitor when i was 18, but all the other stuff i didnt do. im on probation for being disorderly on my way home from the bar.

You are charged with Home Invasion, and you are one of your PO's best probationers? Wow, I'd hate to meet his worst one.

You have done nothing to accept responsibility for your actions, you are only looking for loopholes to get out of this charge.

If I'm on the jury, you will be looking at striped sunshine for a long time.

In my state you would be labeled a habitual offender and be looking at 25 to life.
That said, instead of looking to remove a Tat to try and get out of the responsibilities for your actions, you might want to man-up and and take responsibility.
No, joining the Army isn't an option. As short on manpower as the services are right now, they don't induct felons, and you're already a felon.
Congratulations. You are 23 and you've already thrown your life away because of your own choices.
You'll probably do the 15 minus good time...and that's the payment you make for not living within societys rules.
While you're inside, make a choice and either straighten yourself out, or continue on the path you are already well down.

I'd like to wish you good luck partner, but I've seen too many of you over the years. You're a blight on society.

Okay, so let me get this straight... Tom, mild manored clean cut kid who never did anything wrong, has no gang connections, stand up citizen and all, helping little old ladies across the street in his spare time, etc. gets "jumped". He did nothing, whatesoever, to provoke said "jumping". [If you buy that, I have a bridge for sale] Rather than call the police, right then and there after defending himself, he slinks away and lies low for a while. That way, after 7 months, it doesn't so much look like self defense, but looks like Tom did this in a premeditated fashion [which he most likely did]. None of the fine upstanding citizens in his circle of friends who know what happend thinks to perform their civic duty and call the police [instead, they play the idiotic "nobody snitch" card, a philosophy that only causes more and more crime as criminals are free to walk the streets, causing even more harm to the community that is dutifully not snitching]. Tom's "girl next door" of a girlfriend, so sweet and innocent (most certainly a virgin I might add), gets shot 3 times. Of course, Tom could not be to blame in any way shape or form. He doesn't hang out with gang members, so rival gang members never come by gunning for Tom or perhaps trying to punish Tom by busting a cap in said girlfriend. Surely the 3 gunshots she recieved were some kind of hunting accident! But under the influence of pain killers in the hospital, somehow she comes under the delusion that Tom has a sketchy life, nerdowell friends, and somehow the bullets removed from her body must have been his fault. Suddenly she remembers the whole "jumping" incident, and recalls that she never got around to calling her local polite and friendly police officer to report the incident. So, while the police are there to investigate her hunting accident, she tells them that Tom hurt the boy who's now on life support. [Did I mention I have a bridge for sale.] But now, unfortunately, because Tom never called the police to report the attack, they don't believe him when he claims it was self defense. They think Tom actually assaulted the other guy and not the other way around. [It's a very nice bridge - actually it's in New York, Brooklyn to be exact.] Trust me, when the police find out about all these misunderstandings, what a bad spin the poor pain killer influenced girlfriend has put on this oh so wholesome series of unfortunate events, while they will all have a good chuckle and let old Tom out of jail with a complementary doughnut in hand. [Really, it's such a nice bridge, I hate to let it go, but alas my stocks have tanked and I really need the money.] Or, if Tom is unlucky enough to live in the real world, well, they are going to throw his gangbang'n *** in jail where it belongs and melt down the key for scrap metal.

First of all....Home Invasion doesn't mean enetering a home without permission....Home Invasion is entering a home without permission and using Force against a person, Ie. Robbery. So, either you are not being truthful, or you are mistaken on the charges against you. If they did charge you with Home invasion and you are telling the truth, they HAVE NO CASE....they would have to prove that you made entry into the home with the INTENT to commit another crime....It sounds to me like you are taking the wrong road brother.....maybe you should rethink your priorities in life.....

Removal of your tattoo would be very suspicious. If I were you, I would make preparations to be incarcerated. Since it is your 4th time that does not look good in the eyes of a judge or jury. Since your priors were 3 and 4 years ago, you may get a break. You could try to cut a deal and tell the police some other stuff they might not know....

Well, get your affairs and paperwork in order because it sounds like you are going to be spending a little prison time. Talk to your lawyer and have him or her advise you on the correct plea. I think you should take this time to really think about your life. Next time you may not be so lucky. Removing the tattoo is not the problem, you are a criminal....that is the problem. You need to get into some kind of job training program, get the tattoos removed, if you are in a gang...get out. You will be dead in a few years otherwise. Trust me.

Looks to me like you have had to many chances already its time to pay for your actions maybe some time in prison will teach you some thing but I doubt it you are on probation and in school and you still decided to break the Law thats just stupid
