It was a law passed in 2006 that, among other things, strips away many constitutional protections from people held in custody by US forces -- including Habeas Corpus rights and rights to constitutional due process under the 5th and 6th Amendments.

It has not yet been challenged because Congress was very clever -- they managed to remove the right of the people whose rights have been taken away from being able to challenge those rights in court by removing the authority of the court to hear those challenges.

In short, it is a dictatorial law that allows the US to hold anyone it wants in custody, ignoring all constitutional requirements along the way.
