i have contacted the credit card endlessly, and i am being told that my claim is being declined. I never activated the card and have not used it for over a year, I had a zero balance on it, I never made the purchases they claim I did, I still have the card with the activation sticker attached. I am being called demanding payment, everytime I call they give the same answer, that a manager is going to call me but they never do. Sometimes when I call, they hang up on me. I dont know what else to do. Help me!!

I most cases, you are required, _in writing_ to notify the company of the charges within a certain time frame (usually before the next billing cycle).

They are then required to investigate the claim and notify you, in writing, of the results.

If they have denied your claim, ask them for a copy of the signed receipt. Retailers are required to obtain a signed receipt, and maintain the receipt for a period of time (usually 1 year).

You say you are being called demanding payment and you also say you have not used the card for over a year. Do you not check your statements? If you did you would noticed the charge on your statement, when you got the first call did you not ask where the charge was made? go back and look at your old statements? ask for a copy of your current/old statements? The credit card collection dept doesn't call until you miss a couple of payments.

The credit card company doesn't know charges are fraudulent unless YOU tell them, YOU have a responsibility to monitor YOUR finances. By not responding in a timely manner, you may have lost the ability to dispute the charge. The card company only has a certain amount of time to charge back the store for unauthorized charges.

The other thing is, if all the things you say are true then probably a good chance this "fraudulent" charge was made by a friend or family member. You would be shocked at the number of fraudulent charges are made by friends or family of the card holder.

This is probably the most common excuse for not paying ones bills that they hear hundreds, if not thousands, of times daily. Now it is up to you to reverse the tables and ask for verification of the purchase.

The verification sticker could easily have been removed, the card used and then the sticker reattached so that means absolutely nothing to them. If they have proof you called and activated the card, usually this has to be done from your home phone.

You have some work to do to clear this up in your favor.

Sounds like lots of conversation and NO mention of you notifying them in writing .
No mention of you asking to see the purchase documents with your signature .
What have you done besides talk about it ?

Unless you request proof by means of a purchase with your signature or mail order delivered to your address . . .
They will keep denying your claim .
Lots of people who can't pay claim fraud .
You must pursue an examination of the evidence if you are telling the truth .

I did not see any mention of you requesting to see the proofs of purchase .

send a proof of the card with the activation sticker on it

ask them to send you any paperwork relating to the signature and maybe offer to do a signature test so they can prove it is not your signature

physically go to the credit acrd company and demand to speak to someone in charge who can help

ask them for proof / verification of the charges. send the letter certified. they should have to send you signatures / dates of charges and amounts of charges. you must review them for accuracy and then send a return letter stating that you dispute the charge / it is not valid.

keep a paper trail and do everything by certified mail / return receipt / organize your papers / dates.
