Without implication that the noose was specificaly put there as tool of hate against black people it is pretty hard to actually prosecute someone criminally. If there was a black dummy dangling from the noose or a slur written along with the noose being hung then it would be more specific. You cannot prosecute someone because you feel in your opinion their actions implied something.

No, they would have to have actually committed a crime with intent to be charged with a hate crime. They could possibly be charged with inciting a riot though.

no he cant unless he is outside theartening people with it or has used it to harm someone...
the only thing that can be done is if someone calls the local police and tell them that they feel threaten by it and they may come out and ask to remove it... but thats it... unless he does something with it...

why do people associate a noose with a black person? more cattle rustlers were hung than blacks.
