My step father had a wreck at a intersection with a red light ,he said the light was green .a 21 year old girl hit him in his driver's
side door and when he went over to see how the girl was doing
( she was taping their conversation ) is that legal , she had no drivers liscense and no I nsurance It happended In Brewton Alabama ( The stink hole of the south )

It seems like she watches too much T.V.. Your step father could have stopped talking at anytime, but he did do the right thing by checking on her condition. The recording is legal, but isn't going to help her in regards to not having a license, or insurance.

The rule for audio taping is "one party consent", that means one of the persons active in the conversation has to have knowledge of the recording.

The other consideration is this happend in public. You have a lesser expectation of privacy on a public street.

There is nothing wrong with taping that incident.

Anyone can video tape anyone else in any public area with or with out their knowledge.

Some states have laws against audio taping anyone in public or private without their knowledge.

In this case, he was fully aware she had a recording device and all he had to do was not say anything.

So, no it was not illegal and no laws were broken.

He was aware of the taping. I see no violation of anyones rights.

Yes she can tape it because you knew about it and still choose to speak to her it was for her protection.
