My Partner has just moved into a new home, semi detached. She wants to put a conservatory on at the rear to a 'maximum' size of 9' x 9' . Will she need planning permission or is this classed as permitted development ? It is circa 7 ' from nearest house, no higher than ground floor , less than 10% of total house size and not in any protected area etc. Any advice appreciated. AndyB

You do not need planning permission but you should seek some sort of presedence order from the town hall. You should do this to prevent any hassle when selling the property but it is not a legal requirement.

I think this depends on which County Council area you are in, as they are all different. I would agree with the previous answerer, it will only cost a little time to check out the local rules and regulations, and could end up avoiding any disoutes about whether it's legal or not at a later date. [Apparently one of my neighbours did a small shower room extension, and they had to take it down before the house could be sold, as they'd built it over the drains. That hadn't needed planning permission, and it ended up being taken down}

I have asked the same question very recently. I contacted my local authority and was advised by them to email the specifications and my address etc to their planning department and that they would get back to me in approx 7 days as to whether I need permission (mine's slightly a bigger size, just taking over the 3m x3m that does not need permission)

EDIT - also be aware, as we found out today - if you need to resite a drain, then you need building regs

Best to give then a call as we have been caught out also by the fact that the back of our house is within 20 m of a public right of way (al be it a back alley) yet if we our garden had just backed onto another garden it would not have been needed

best to get it in black and white from your local authority

you may need planning but your local office will tell you ..best to ask them ..but you will not need building regs
