He works 2 jobs and see's his little girl every other weekend, he pays child support every month. The mom lives with her parents and has a hard time keeping a job, she makes no effort in changing any of this. What can he do to see his daughter more, and if he tried could he get sole custody?

He works to jobs to help pay for the child support and other bills, but if he had sole custody he would quit one of them.

just cuz she lives with her parents and cant keep a job isnt enough to get his kid sorry I know what he's going threw my brother went threw it too. In the South it is very uncommon for the father to have custody. My brother in law got his kids cuz his wife was on drugs and she really didnt even fight for them.

Well... his working 2 jobs isn't necessarily a good thing... a court could say that he's TOO busy for his kids. The mom lives with the child's grandparents and there are plenty of people to care for the kid there.

He could petition for 50-50 custody, or at least try to see his daughter every weekend if he wants more time, but it's unlikely for a father to get sole custody unless the mother is a criminal/ drug/ alcohol abuser.

Unless the mother is a crack whore and he could prove it, he probably would not be able to get custody. You seem to be making assumptions about the mother and her efforts to change her situation. She is the one that has to make a life for herself and her child. Whether your boyfriend realizes it or not, that child support he pays is not the sole support of his daughter. I doubt seriously he would be able to quit one of his jobs if he no longer had support payments to make. Let's be realistic.

in any state the judges are looking at the most reliable, stable parent ... and whether or not the child will have a good home life ... does he have his own home? how about her own room in an apartment??? stable relationship? daycare options when he's working ... talk to a lawyer ... they will give you the best advice and chances on winning.
