he was charged with assult 3 years ago I do not have time to apply for a visa will he get in i cant change the holiday or get my money back

Where you coming from? From somewhere in the US, then you do not need a visa. From a coutry that everyone needs a visa, then you are out of luck. A month is plenty of time to get a visa. Doesn't seem that you planned very well.

Why Not go ahead of your planned event? I mean - many people travel nowadays with no visa and since you stated that the assault charges were 3 years ago - believe the cops, ICE, or who ever have bigger fish to fry!! I am assuming you live in the US - so new passport regulations do not start until Jan 2008. Go on with your plan and have Fun!! Just make sure your husband stays out of trouble...........Just wonder - if you had the money for the trip, why didn't you use it to get a visa for him for a birthday present????

First if you are coming from outside the US and entry requires a visa you need a visa,
on the assault charge, in the US, what level of assault? do you know the out come?
