I have a friend who is AWOL from the Army National Guard. If she is cought what will happen to her? What will happen to me if they find out she is living with me?

Currently, the military is not actively seeking people who are AWOL. There is probably a federal warrant for her arrest, and if she is pulled over or for some reason come in contact with the police, she'll probably be arrested. She'll be sent to the nearest base and prosecuted. She'll probably do a year in military jail and get a dishonorable discharge.

Hard to say if they would prosecute you. Probably not.

They will not come looking for her as other people have pointed out, but she will be arrested for any violation after she is AWOL for 30 days.

In addition, she cannot get any federal aid, student loans and will have problems filing taxes.

Tell her to go back. Thats the best thing for her. Expecially since she is a coward and basicaly has the same effect on the unit as if she shot a battle buddie because now there is one less person to man the perimeter.

You could get in trouble as well, but I dont think it would be worth the governments time or money to do it, so more then likely nothing unless lie to the government if they call or anything.

She will be charged under the Uniform Code of Military Justice and you may face a felony charge for helping her. The best corse of action is for her to turn herself in, the Military Police will find her, it's only a matter of time. Going AWOL is one of the most cowardly acts anyone can do. Do you want to be charged with felony aiding and abeding? If not, turn her in. Her career is already ruined and she will never be able to get a decent job because of this. Employers will not hire someone who has gone AWOL.

Has she actually been declared AWOL or AFP (absent from post)? If she goes back now, and it's only AFP, she'll be reprimanded but it'll be like a misdemeanor. If she is actually AWOL, she's in deep doo-doo. That's the military equivalent fo a felony - that means time in Leavenworth military prison.

My advice: go back now. She's about to screw up the rest of her life just so she can live with her boyfriend. Remember, we're at war at the moment - deserters are not looked on kindly.

A soldier member can be AWOL for up to 30 days without being 'Thrown into Jail'. If she returns within 29 days she would probably get a Field Grade Article 15. (Most likely lose rank and pay for a little while) and have extra duty. Tell her to return because an article 15 is better than jail.

Depends on the situation. Did she leave because her unit was DEPLOYING somewhere or going to some SPECIALIZED training like the NTC (National Training Center) or gone 30 days or more??

If she left because of that its called DESERTION which is a lot worse then AWOL. The penalty for Desertion goes anywhere from jail-time to death. They wont seek the "death penalty" and havent since the 1800's. She will spent 2-3x as much time in jail tho as if she was AWOL.

Now if she is just AWOL and isnt a DESERTER, the best thing she can do is TURN HERSELF IN as soon as possible!! I was in the Army for 12yrs and just got out this Feb 07.

The last few months before I got out I was in charge of escorting the AWOLS and DESERTERS the military caught and those that turned themselves in. You know what? Those that got caught, got automatic jailtime by the time the COURT-MARTIAL came. The ones that got caught and were gone 1 year or more stayed in the HOLDING CELLS at the MP station till their court martial. The AWOLS got anywhere from dishonorable discharge to about 3 months. The Deserters got 1-5 yrs in jail.

The ones that turned themselves in from AWOL usually got a dishonorable discharge and were out within 2-3 months after turning themselves in. The Deserters that turned themselves in got anywhere from a dishonorable discharge to 6 months in jail.

So, Tell her to TURN HERSELF IN, more then likely she will be home for Thanksgiving, and everything cleared, and she wont have to run anymore.

And by the way ... nothing will happen to you. Only thing thats going to happen to you is guilt ,if you dont help her out of this by telling her to turn herself in and her punishment is worse then it can be.

I agree with dsanthony, with the exception that I don't think there is anyway she would spend an entire year in jail. I would say she would processed in and out pretty quick. It isn't exactly a high priority. I don't think there is anything they can do to you.

Has she been gone 30 days or more? If yes, then she isn't AWOL she is a deserter. It is different and comes with a harsher punishment.

Take a look (Google) at the UCMJ and what it says about how an AWOL case is handled. This applies more to those posters that have no clue about military law. You do not take her place for aiding and abetting. Do a little research before spouting some uninformed gibberish.
