OK here is the problem... My cousin is a Security Officer at a rather large mall. This mall has a very popular night club that is open wed. - sat. nights till 2 am. Up till last night he has always checked on people that came outside the club ( the club will not allow the security company to have officers work inside the club itself, since they use off-duty city cops, but the company is responsible for the rest of the mall, including the parking lot.). Last night his sergeant got onto him for checking on a woman that was clearily drunk and didnt have a designated driver. He was told that it is not their responsibilty to check on people coming out of the club, but the club had to do it. Now, he is in a " damned if ya do, damned if ya dont" situation. Should he continue to check on these people, or should he turn his head and hope and pray they dont get in a wreck and kill themselves or someone else? Let me know what yall think.

ok alil more info... He works in Texas and is a certified Security Officer, and under state law, while in the commission of his duties he has the same athority as a police officer, except that he can not arrest people..... Also, some have said in their answers that he should contact local law enforcement to handle it, but his supervisors ( including the Sergant and his Lieutenant, and the head of the company) all told him that he is to take NO action at all.. including notifying local law enforcement

well he should get his duties defined in detail by his employer and if they own the land that they want him to check on then the other guy has nothing to say on it.

As long as he is not harassing the people for no reason then he should be fine.

He has no obligation to babysit drunks. His job is to maintain the integrity of the surrounding bussinesses. While he is messing around with a drunk person, the other shops could be getting robbed. It's the police's responsibility to deal with drunks.

You mention that the club has it's own security, and it's hardly a well-kept secret that drunk people drive home from late night clubs. If the cops want to stop it, they shouldn't have any problem doing so.

He was doing the right thing, but... he has a legal obligation to follow his bosses orders.

His best course of action is to call the local police and report these types of incidents. Drunk people can often be argumentative, and even violent. If he gets hurt, and his employer deems he is out of his job duties, he may not be eligible for workmans comp.

Since he's not a sworn officer, I don't believe he has the right to check them. He should contact the local law enforcement and let them know he thinks there is a problem at the club and maybe the'll start sending a unit to the club around the time the bar closes.

i think he should do his job and only his job. I mean theres stupid people out there and you cant help all of them. if someone is gonna drive drunk.. then thats their problem or the clubs problem. He could lose his job maybe if he doesnt follow the rules. A person can only do so much. It would be nice if he could help.. but guess they dont want him to

You cannot be your Brothers keeper. The club would be held responsible for any accidents. He has a choice. His morals (which are good) or his job.

His sergeant is wise. What if your cousin gets himself injured or killed by a drunk or other wacko in response to something he wasn't assigned.

it was nice that he try and stop her from driving, but if he is going to lose his job for it, just call in her tags as they drive off, anonymously on a cellphone.
