You should be required to pay for the fact he got hurt and be fined for the fact you hired someone who is illegal. I hope you were at least smart enough to have an insurance policy for your business.

The worker's immigration status would not affect the case in any way. An employer cannot get out of his obligations to keep workers safe and follow labor laws just because he is hiring illegals. If that were the case, everyone would hire illegals just to shield themselves from liability.
And lawyers, being private businesses, do not check your immigration status before taking your case.

You are getting some bad advice here.I am sorry to say it but you are screwed and you are going to get sued and more than likely charged with a crime.Being a Contractor I know the Workman's comp laws and you are required by law to carry workman's comp insurance.The insurance company has no idea who works for you until a claim is made.I think you made a horible decision on hiring an illegal because that illegal is going to file liens against the property he was working at so get ready for 2 lawsuits.Use your head next time.You better hope you are inc. because you are going to feel the train running up your rectum

Tell you what... In my opinion, the illegal alien should have no recourse...
But neither should you. You broke the law knowingly by hiring the guy. The government should come after you and take the money--perhaps treble damages(three times what he's suing you for)--and use it to deport him. You hired an illegal alien thereby aiding and abetting a criminal in the commission of a crime....
People who hire illegal aliens deserve what they get. When you learn that it's not wise to break the law, then maybe you'll stop doing it. And they should go after the lawyer too. If it makes it becomes too costly to hire illegal aliens, maybe you'll stop doing it.
Sorry, but you made your bed... now you have to lie in it.

if you hired an illegal they could owns you > If you didn't have insurance & claimed them correctly>cheap labor is cheap>>Home owners are really scamed and some can lose there homes>>There are attorneys waiting in line to defend them>$$$$$ The laws are made by attorneys> Beside it against the laws to hire an illegals>

First off they should not be allowed to sue you. They have no rights ( or should not anyway) in this nation. Second off if you hired illegals your business should be taxed in to bankruptcy and you should never be allowed to apply for welfare or unemployment as a punishment.

I'd have someone else fill out the report. If you knowingly hired him/her you are guilty of a crime yourself. Your workman's comp certainly won't pay because you aren't able to submit it for illegals. He can end up deported but he will probably go with a big hunk of your cash.

you need to pay.........not because you are affraid of the law, but because he was your worker, and we all need to consider one thing beyond the law: ETHICS.
You can avoid all the trouble by just acting with him/her like you will act with any other employee. Good luck and remember, fairness is not measured by the human law, is God's law.
