I got into an auto accident while driving at a snails pace through a store lot;the other person backed into me at close range; I honked my horn as soon as I realized- but she continued on! At first she did not want to wait for the police, I insisted we wait. She called our mutual insurance co. to report it. Initially she admitted 100% fault-to me. I spoke w/ the ins. rep. but refused to do claims adjuster q&a; answered the basic identifying ?'s & confirmed that we were wearing our seatbelts; I provided my policy # to the rep. on the phone. Ltr I realized that the rep did not provide me with a claim number. I called the insco. back- the rep let it slip that I would need to go through claim q&a because my story of "she hit me" differed from what she had told. The hitter told them she was half way out into the lot when we connected--- trying to make it sound mutual! Untrue! End result, she got cited and the cop busted her for lying based on the phys evidence.
What should i do now!!!

Let the insurance adjustor and company handle it. You win. Person backing out is always wrong. You had the right of way which is why the Police ticketed her. Not only did she lie but she is also dumb for thinking she could blame you. That's like coming out of a parking space on the street.

One of the things that you never want to do if you get in an accident is admit fault right away. There might be an extenuating circumstance on the other drivers fault that might change the whole situation. That being said, she did exactly this and you should have the police send the information to the insurance company, and if you do have to go through a question and answer session, you need to explain that she admitted right away that she was at fault.

Your last sentence says it all "she got cited and the cop busted her for lying based on the physical evidence"

Get a copy of the police report. It should show a diagram of the accident. If there isn't a report, your adjuster can get a copy of the police officer's notes.

The type of damage will definitely tell most of the story here. If the damage to her vehicle is to the rear, and the damage to your vehicle is to either side, it would tend to indicate that she was backing up, and autmatically indicate she was at fault.

Were there any witnesses?

I think you're ok, but make a diagram for your adjuster if you have to. You have to help prove that you are innocent.

She screwed up. In the heat of the moment, if she popped out of her car and said I'am sorry, my fault, etc. That is called a excited utterance, which is usually admissable in court. Document everything, including any witnesses that may have been in your car at the time of the accident. Honestly, if you are younger, the adjuster is going to give you a harder time than if you were older.
Keep on the adjuster, and make sure he knows you are going to stand up for yourself. Do not let them write the accident off, (which they might if it is minor), because it will be a negative on your insurance report.

Let the insurance company know that the other person got cited for being at fault. If you contact the police department they can either give a copy of send it to your insurance company so they can verify it wasnt your fault.

Ugh, I love how you wouldnt even tell the adjuster what happened but you expected them to "magically take care of everything for you" - are you happy you didnt give a recorded statement now?

Hopefully, since you wont cooperate, they can accept liability AFTER they get the police report. But since your so eager to stay quiet.. why dont you just wait til they investigate and maek their decision?
