My father in-law paid 10,000 to get his brother out of Elizabeth detention center after being caught by immigration for being an illegal resident. The bail as I understand it is to ensure he will come back to court when it was agreed. Now my question is: Can we request to get our money back and let them persecute him, or do we have to wait until the court day and his extraction from the country to actually get the money back. Thanks.

He paid it all in cash. There was no bondsman just the lawyer who paid the payment under my name.

The money has been paid into court. Its purpose is to encourage the defendant to appear. I cannot imagine a court returning bail money until the case has been disposed of. You might be able to argue for a bail reduction but that would require showing that the defendant is likely to appear on the set date.

I am not an immigration law expert but you will not necessarily have to wait until he is removed. perhaps if your father-in-law asks the attorney he will get better answers than you are getting here.

Best check with the bail bonds some don't return the 10% as there fee>

I think you must wait. My son has put down $5,000. bail and must wait until the court date to get it back and that is only if the judge doesn't take fees out of it.

yes you can, call bondsman and tell him you want you money back, and he get the man baack into jaila and you get you money back.

you can pull his bond money, and he'll be tracked down and held until his court date.
