The baby was born in December. The once thought father signed the birth certificate and took several paternity tests months later saying he was not the father. This is where I come in. I met this girl once. I went to NJ in August to see the baby and go to court. I wasn't able to take the test in NJ and told to take it in Colorado a week later. I was told they would contact me. Over a month has gone by and still no word. I called and they have all my correct information and keep saying they will get to me. The mother does not want any child support. I'm just wondering if a paternity court order can be dismissed after a certain amount of time. The whole thing seems really shady and I don't want to get screwed in the end. I'm afraid she will come after me financially years from now. Any advice out there?

My husband and I went through this with a girlfriend of his prior to our marriage. We lived in Tennessee and she was in California. Years after we were married she went on welfare and through the interstate compact Tennessee ordered a paternity on behalf of California. He went to court in TN and gave blood for the test, California stalled so long that TN dropped the case. We were then notified by California that they were closing their file because she wouldn't comply with getting the blood test. So they can be dismissed but not because of time. A court order stays in effect until the court says otherwise. A month isn't a very long time to wait so you may still hear something. Before she comes after you financially you have to be proven the father. Alot of states will not make child support retroactive unless there was a court order or she was on welfare and the state wants to be paid back. If you have a decent relationship with the girl then I would maintain it. On the off chance that you are proven the father I'm sure you would not want to miss out knowing the child. Then again if you do bond with child and are proven not to be the father then that could be devastating for you and the child. As far as financially, I've not dealt with any cases where paternity was proven and the father had to go back and pay child support prior to the test. Unfortunately though if this case gets lost in the system she can petition at anytime for a paternity test so until the test is done you'll always have that possibility. You do need to maintain contact with the court also, if there's a court date and you miss it, Judge's can issue "paternity warrants" for your arrest.
