For full details on this, see my previous post. Day or 2 after the post, the kid did end up beating up my son. Police were called to scene. We had witnesses. Filed summary offense. Parents, I hear, didn't care/weren't mad at their son for police coming to house. They let him go back to same fair 2 days later. I consulted a lawyer, gave him okay to write a letter which will be sent to parents, school officials. My next step lawyer says will be either file civil complaint or private criminal complaint (which lawyer leans toward). My son did not go to doctor, he had wounds on his head from being punched so hard, skin broken open and a 4-inch gash on his arm from falling. Kid is spreading rumors about my son now. I have someone who will testify to what he says. I really want kid to leave son alone, am afraid he will indeed get my son again. I'm afraid lawyer letter will infuriate kid. My son is in fear for 2 years now. I'm leaning toward civil suit and would like opinions

I did talk to lawyer, no doc bills, and my son knows martial arts. I said all this in this post and previous one. I just want opinions on private civil suit, its possible outcomes, would it be effective in making parents and kid wake up and leave us alone.

i'd do too things . First , write the letter the lawyer advises. I'd also modify the letter to indicate that the school has liablity for the safety of your son on school property. I would take pictures of the childs wounds and I'd go see the principal in person and ask him how this could be allowed to happen on schoool grounds / I'd let him know I expected an answer. Escalate it to the school board if you don't get the satisfaction.
Lasty, I'd enroll the kid in some boxing courses / or some of that japanase style fighting . After about three weeks / my kid would be seeking that kid out / not on school property and the other kid would be black / blue. Hopefully, that would put an end to all this nonsense.
I would not worry about the letter who or he infuriates. It's time this bad kid does get infuriated. He needs to really get knocked back hard. I don't really believe in it , wish there were other options. But if that was my son. He'd be training in boxing and i'd send him in with a roll of nickels. I expect one fight is all that would be needed. Wasn't there a movie ...Bells of St. Mary where the nun taught the boy how to fight. LOL.. Watch that it might lighten your spirtis. It depends on the state by parents are often vicariously liable for the actions of their kids. Moreover, if the parents know about a problem and don't take steps within their power to solve the problem, the parents may be liable for negligent supervision. Of course, keeping the kid out of school of in the house 100% of the time is probably not a step they are supposed to take.
If this occurred at school, contact the school and let them know that something needs to be done. Once they are on notice, they better do something or face financial consequences later. If this occurred at a fair, let the fair security people know. It sounds like you are on the right track.
If there are other places where your son might run into this kid, perhaps you should keep your son out of this kids way. Also, keep calling the cops. Eventually, they'll keep looking for the kid and something will have to be done. It's the squeaky wheel that gets greased. But don't piss off the cops or they won't take your word for it.

Take your son to the doctor, he would make a certificate that your son was injured, don`t waste any time the sooner you go the better.
If this is a school fair consult the school, see if you can get the bully to be expelled or at least banned from the fair. If they don`t respond be prepared to sue the school and make them expel the kid or pay for a private school and investigate if the kid is related to high figures or if there was a bribe.
Also if the kid is dangerous to your son he is dangerous to other children, see if you can get other parents to sign a petition.
As for the rumors they will end when justice is done. Kid will be enbarassed.
As for the parents they`re extremly irresponsible, see if you can make them part-responsable for this behaivoir.

Sounds like these parents have some kind of narcissitic personality thing goin on or just don't really give a **** about the well being of others. In all honesty, the thing that bugs me the most is that the bully is starting rumors. I mean, that's the kids reputation right there. I mean, I know you're a woman and all, but from a guy's perspective, if I had a son, I would tell him to fight the bully again and kick his *** using his martial arts. You suing them is on a different level from your son learning to fight for himself. They're 2 different things. One, you're protecting your family, but your son MUST learn how to stand up for himself. I'm only 19, but I'm telling you. Learning to stand up for himself is one of the most crucial skills he has to learn in adolescence. Get your kid a mature male mentor.

you are out of pocket for medical and legal fees through no action on your part.
if this were a car accident, you would have auto insurance prepaid for this occurrence. Whereas your homeowners or personal insurance may cover the injury, your legal expenses are not covered.
