I was pulled over for speeding (51 in a 35) and the police officer gave me a ticket. He said that he'd give me a break (it was my first offense in my 10 years of driving) and write the citation for impeding traffic instead of speeding.

He said that I'll pay a lesser fine and have no points on my license, nor will it be on my driving record. Normally it is 4 points.....what is the difference in speeding and impeding traffic??

Speeding is just that.... driving over the posted limit.


Impeding is usually for people driving to slowly on the road way and thus impeding the flow of traffic.

So, obviously the charge he gave you is a lesser fine with no points.

I routinely stop people for speeding and if they have a good attitude and no priors, instead of a $200.00 speeding ticket with 3 points, I give them a "fail to carry proof of insurance" which is a $75 fine with no points.

The bosses say we have to write tickets.... but not what they have to be for. I am not into jacking up the good people on expensive tickets. But, it still gets the point across and doesn't hammer them too hard.

He was trying to give you a break while still giving you a ticket to remember to drive safe.

As a note: Good attitudes always get better treatment. Bad attitudes get the full boat ticket.

*Edit:

Oh, and as a note to the guy above and his answer.... You go to court and the officer can ask to have the ticket amended and to charge you with the full speeding.. and the judge will grant it as that is perfectly legal. And then, you can get jacked for the full speeding fine, points AND court costs.

I have done this many times on people I have tried to give a break to that think they can out smart me.

It's a scam carried on in my town too. If they don't write a ticket for speeding they don't have to fill out a ton of paperwork that takes up time that could be used to write more tickets. How can you write one for interfering the flow of traffic when you were stopped for speeding? They are opposite. I would think that would stand up in court. Oh wait....the judges get a cut of that. Never mind.

Speeding means you were going over the posted limit. Impeding is interfering with the flow of traffic such as stopping in the roadway, slow driving etc. I would like to know what the officer was thinking when he issued the ticket. If it were me, I would fight it (and win) since the ticket was for something you are not guilty of. Your choice.

IMPEDING TRAFFIC MEANT YOU WHERE DRIVING IN A MANNER THAT WASNT WRECKLESS, BUT EFFECTING TRAFFIC AROUND YOU, IE CARS MOVING TO GET OF YOUR WAY, ERRATIC BREAKING....STUFF LIKE THAT...ITS A SLAP ON THE WRIST COMPARED TO A SPEEDING TICKET

Impeding refers to obstructing. If the violation was changed from speeding to impeding, it should be dismissed. The violation is incorrect, and contradictory.
