Earnhardt Sr. was, but as far as current drivers, I'd say Tony Stewart, Kevin Harvick, Kyle Busch, and Robby Gordon are all tied for the dirtiest.

Since you said Nextel Cup I believe you mean current drivers so that makes it a little tough, They all can lose their temper at times and be"a dirty driver"
I would have to say that Tony Stewart is tops on the list even though he is my favorite driver. He has been branded a hot head and sometimes lets things out of his mouth that get him fined. This is why he is my favorite.
Next I would say is Kevin Harvick after the Jaun Pablo thing, and third I would pick Kyle Bush
