A friend has an office job. She also has mulitple sclerosis. She has been told at work that if she is not 100 percent then she is not aloud to come to work. Also she has been told that if she takes any type of pain medication then they dont want her working either. For those of you that are familiar with ms, you know that being 100 percent never happens, and in many cases a person with ms must take pain meds on a daily basis to even function. as far as I know they have not told the rest of there workforce these same requirements. Before they found out she has ms they never said a word if she was not at what they felt was 100 percent. If you know anything about workplace discrimination please let me know

people thanks for your answers. i am well aware of ada, this has nothing to do with providing her accomodations. this is simply a case of whether or not an employer can stipulate 1. you cant work if your not at 100 percent, and 2. if you take pain meds you cant come to work. yes ms is a covered disability. i was looking for someone that had actual legal insight not people that are guessing go back to your relationship questions

Yes it falls under the discrimination of the physically handicapped, contact the labor board and file a formal complaint and the issue will be investigated. Visit this website http://www.dol.gov/odep/pubs/fact/rights.htm it contains specific references to the laws that protect the disabled and how to report discrimination under these pieces of legislation

The ADA first of all states a REASONABLE accommodation, secondly just because it is prescription drugs it is the same as illegal drugs they have the same effect. Example if you are pulled over for driving under the influence and say that you are using prescription drugs you will cited for DUI drugs are drugs whether prescribed or not. the company is just covering themselves and the employees

Sounds like discrimination to me. I assume that if your friend doesn't work, she doesn't get paid, so they are preventing her from earning the agreed to salary. I think your friend should either get a lawyer and check out her options or find a new job without the same stipulations.

The question here is if you would be covered under the ADA (Americans with Disabilities Act).

I would think this is unethical. And immoral. Now companies have their own policies which should comply with the laws of the State your company is in.
Sounds gross indeed. All the best to your friend.
