Many sites cite skin to skin contact as the source of Herpes 1 transmission. I have a herpes canker sore on my tonsil. Can I spread this when I kiss on the lips? Also, can it be spread through oral sex if it is on the back of my throat?

Additionally, what if I am not breaking out.. can it be spread then?

Yes, yes, yes. You can spread it to another mouth and also during oral sex. You need to talk with a Dr. and get some counseling on this.

Canker sores and cold sores are NOT that same thing.

Canker sores are basically ulcers that usually occur INSIDE the mouth. They are NOT herpes and are NOT contagious. Canker sores can appear on the tongue, cheeks, gums, inside the lip, etc. They are painful and can take weeks to heal. The exact cause of canker sores is unknown but they can be caused by several different things like food allergies, braces, stress, accidentally biting your cheek or tongue, and many other things. Canker sores are VERY common.

Cold sores (oral herpes) almost always occur on the OUTSIDE of the mouth. They can appear on the outside of the lips and on the outside corners of the mouth. Cold sores ARE a form of herpes and ARE contagious. They can be spread by kissing someone who has them, sharing drinks, lip stick, chap stick, etc.

Cold sores are not spread by saliva. Herpes is a DIRECT skin to skin contact disease. A person needs to have DIRECT skin to skin contact with a herpes sore or the infected area in order to contract the virus.

Yes to all of the above. You have to be in the middle of an "outbreak" so to speak, if you have the sore.. So yes the virus is active in your system and if you give oral it will turn into HSV 2.
