He would be charged under Article 112a. (Wrongful use, possession, etc., of controlled substances) and if convicted, he could face up to 10 years in Leavenworth and then a Dishonorable Discharge, which means he will never hold a decent job because of the conviction and DD on his permanent record.

"Any person subject to this chapter who wrongfully uses, possesses, manufactures, distributes, imports into the customs territory of the United States, exports from the United States, or introduces into an installation, vessel, vehicle, or aircraft used by or under the control of the armed forces a substance described in subsection (b) shall be punished as a court-martial may direct."

With a DOD military drug policy of ZERO TOLERANCE, more likely a court martial of a BAD CONDUCT DISCHARGE & PRISON will be issued. He will NOT be going to Iraq regardless of the fact that "they need all the help they can get". He is briefed on the DOD policy at basic, after 6 months in the military and at the time of reenlistment or commissioning. No excuse......>

Is it he was going to Iraq or is going to Iraq? I am confused. He will get a bad conduct discharge along with further discipline meeted out by his court martial. Could be a few years in the brig or even Leavenworth. Either way, I am glad I am not him.

Yes and no--he will just proboably transferred to Fort Leavenworth. Being in the military does not give you the right to break our countries laws. We do not have a military state, therefore, no one us above the law. He will proboably tried in a military court and then be sent to Leavenworth.

No, he will probably be put in military prison. The last article I read about a soldier smuggling ecstasy said he received 6 years in military prison.

I am siding with the folks that say he is going down hard. I bet he goes to military prison.

Here is the deal, no tolerance, and if you do the crime, you will get the time. So this is a pretty good deterrent. But not 100% since your buddy was stuipid.

People like "Babe" astound me. I assure you, the military does not consider drug smuggling minor. Your friend is most likely going to prison, right where he belongs.
