I got a letter from what looked like a lawfirm and it turned out that it was... but it wasn't a letter from a lawyer it said so on the bottom... but the letter frigtened me into to calling them before I understood all of my rights.

I told them I could pay everything the next month... and that my husband was overseas... I didn't know anything about disputing debts at that point and well my husband just went to Iraq and suddenly I get this letter that makes it seem like they will take him to court!!!

So I just wanted to avoid that at all costs because there is no way he could possibly be there!

They didn't want me to pay them next month and they didn't mention that I could try to pay them half or anything... I DO have a house payment so there was no way I could pay it all!! I could probably have offered to pay half if I wasn't so afraid and was able to think correctly but they scared me...

Then they told me that it was "OUT OF THEIR HANDS"

What does that mean??

I think they tricked me. The woman I talked to said something about how there would be fees.

I can't afford fees!!!I Just want to pay this off and not have my husband get called to court. Because he CAN'T be there... and if he isn't there he loses automatically... and if he loses automatically theres isn't anything to take but our only car!!

I'm really scared and I don't know what to do... the debt isn't even for that much and I feel like our life is ruined!!

I can't sleep at night or relax in the daytime because if we get sued even for a little bit what are we going to do?

I can't even talk to my husband about how afraid I am because he doesn't need this right now and he can't do anything about it anyways...

Firstly they should have not discussed this issue with you it is a breach of privacy. Secondly my ex was deployed when one of those letters came as well. Most company's have a policy that if the debtor is deployed that no further action will be taken in regards to the debt until the debtor has returned.

I suggest you write to then providing evidence of his deployment advising that he is not contactable at this stage and the date of his arrival home. I hope this is not a joint loan as if it is not you have no responsibility to comply with them.

Also if they sue him they will need to serve the summons on him. Due to this they can not. they have a period of 30 -60 and 2 attempts to serve the summons before all action is lapsed if you receive any further mail from them do not open it send it back as a rts. As at this point legally he is not at the home address if mail is opened and not returned the law advises this is sufficient evidence that the debtor resides at the address with this they can commence proceedings.

Don't let letters frighten you if you have any further issues seek legal advice.

Please contact a lawyer or legal aid immediately. Take the letter you received to the office and explain everything that happened and everything that was said.

You need to know what your rights are, and the rights of your husband are before you make any arrangements to pay this debt.

I do not know if you live on a military base or not, but you can go to your husbands commanders who are not deployed and ask them to direct you to some legal assistance.

You have to be very careful, there have been incidences of shams and scams being perpetrated on military families in order to pressure them into paying for "debts" that do not exist.

If your husband is on active duty, there may not be much that lawyer can "legally" do.

I believe since he is deployed, there is some type of extension or excuse you can give them to get off your back or suspend the account until he returns. That's happened to me too. Jennifer
