If my spouse is unemployed and not collecting any unemployment benefits can I clain head of house hold.
She has been out of work 4 months of the year.

You have a better tax rate filing married. You can file married even if only one of you has an income.

Assuming that you have lived together at any time since the end of June your only options are Married Filing Jointly and Married Filing Separately.

Married Filing Jointly would be better than HoH anyway, so why would you possibly want to file that way??

You can only file HOH if you are considered unmarried at the end of the year AND you have a "qualifying" child. Just file a married return with your wife, its much better anyway.

No you can't, but you can file a joint return whether or not your spouse has income..
