A friend of mine is 18 years old, and her boyfriend is 17, almost 18 (in December), and we all live in Ohio. They have been together for about 6 months now. They both talked to the boyfriend's mother about having sex, and she is apparently OK with it. Since this guy is so close to being 18 (in December), if they have sex, and his mother is ok with it, can my friend get in trouble for it?

No. Ohio has no statutory rape laws and the age of consent is 16. The only problem is that she is 18 which is considered an adult and 17 is still considered a juvenile. There is a law relating to contributing to the delinquency of a minor, but I doubt that anyone would complain. Seems that everything is consensual, so if everyone is okay with it.. tell her to use condoms. Oh, just for the records, being close to 18 is not being 18. close doesn't count.

Davis L said Ohio has no Statutory Rape law. The term statutory rape is not used, but the link below is the law in question. As long as both parties are at least 16, it appears this is not a crime under OH law.

If the Age of Consent is 18, then it is technically Statutory Rape. Almost doesn't count.

If 18 is the legal age it shouldn't be a problem. Just be sure to use protection.

i actually heard from a police officer ( in ohio ) that the legal age is 17. i wouldnt believed it if i didnt here it from him.
