My sons mother and I are going to court over our son and part of the order states that the child must be driven by someone who carries insurance. At one time she lived in an apartment with her mother and had insurance on March 18th, but on April 15th her insurance was canceled. On May 28th she stated she was moving out on her own, but she really lives in a one bedroom with her mother and my son, she refuses to show me insurance so I called the police, they say that the registered owner has insurance so my son could go as long as the grandmother was driving. I released my son and when the police left the grandmother exited from the drivers side and my sons mother got back in the drivers sit. How do I prove she has no insurance?

You can't prove anything....the judge if so inclined can require she provide evidence of insurance and then the judge can call if they want to verify it is in fact a valid active policy.

That is a tough one, most states do not keep a central data base for this kind of thing to check on. So what I say to do is keep documentation of all conversations with her, contact the courts since they are the ones that ordered her to have insurance. However in most states when a person loans there vehicle they also loan their insurance so if she is driving grandmoms car she is technically covered, and has insurance.

Take a photo of the child being driven by the person you believe does not have insurance, because they refuse to show it to you.

Show that photo to the judge, as evidence that custody of the child needs to be removed from these two women.

If they refuse to show insurance proof to the judge, then your photographic evidence is enough to have the child removed from their care.

Anyone who is driving ought to have insurnace, whether child passenger or not. Should not need court order to demand that.

Hire a private investigator to take pictures.

That should be simple. Have her show the card which verifies her coverage.
