I have a Premiere Bank credit card... I am not late on any payment yet for the last 3 days I have been getting constant calls from them. Today I called them and I was told that they were giving me a courtesy call that I was 10 dollars over limit on my account. I asked If I was late on a payment or If I missed a payment? They said NO. I responded with “Then why are you gusy harassing me?
They said that they will call me every day as much as they want until I get back on track.. I was upset to say the least! I said you are harassing me yet I am still current..

What can I do?

Is it true that I can write them a letter indicating I want all correspondence by mail?

Please help!

You are OVER YOUR LIMIT technically you owe them a payment until brought within the limit.

You do of course know you are in for a huge over the limit fee as well which continues to keep you over the limit until you pay.

YOU are in the wrong the original creditor has different guidlines over a collection agency.

YOU ARE WRONG get off your high horse.

If you are over your limit, then you have violated the terms of your contract with them even if your payment isn't late. Get the payment in, and pay at least a little more than the minimum payment to get below your limit.

This isn't harrassment.

It was just a courtesy call and you overreacted.
Cease and desist let ters are only effective on third party bill collectors.Attempts by the origanl creditor does not fall under the FDCPA.

yes under the cease and desist law
public law 95-109,section805-c of the fair debit collection practices act.

just write and include the above information, tell them you wish to only be contacted by mail or e-mail, any other contact by them and you will report it to you attorney.
start making your payments on-line, that way your can see whats going on and your payments credit to account faster.

I don't know about the whole "correspondence" thing.

But if you are over your limit then you are not "current."
