I was in an auto accident about 4 weeks ago. And today I have court for a ticket that I recieved. I got the police report a week after the accident and in the report has the wrong weather conditions listed in it and the other person that hit me said that I was on a cell phone. Ok the officers never asked me if I was on a cell phone and by the way I dont own a cell phone. I got a ticket for failure to yeild and I did yeild, her car was behind a diffrent car that was turning. In the report it lists that I was going 30 mph and there is no way you can go that fast in that intersection! I was going about 15 mph. My car was totaled and I have never had a ticket in my life. Does anyone have any advice for me. Also on the report it says that I got a ticket for inattentive driving and I didnt get a ticket for that either. So the whole report is not even right! Does anyone have any advise for me?

Plead not guilty.

Get a weather report from weather.com for the day in question. Compare it in court to the report.

Get your phone records. Show that you were not on your cellphone during the time in question. If you don't own a cell phone, ask the prosecution (before the trial) to prove that you own one.

Doesn't really matter if the car that you got into accident with was behind a turning vehicle.

Whoever had right of way, has right of way - and you didn't yield....even if you didn't see that vehicle. You have to wait till you know it's clear to turn.

I'm not sure how much the inaccuracies will matter.

Contact your attorney, take all available documents (tickets, accident report, etc.) to him and have HIM advise you of your course of action. You have too many variables in the story to receive an accurate or complete answer through Tahoo Answers. Good luck.

Plead not guilty. Explain to the judge what you just said. The other driver lied. The report is full of errors. The police did not properly interview you.

The cost of a lawyer is cheaper than the increased insurance you face. Get a lawyer.
