I saw in the news that this lady and man were caught red handed in robbing a bank and they were charged with 3rd degree......if they were the only one's in on it, and were arrested at the scene.......how is that not first degree if they were caught red handed?

100,000 was stolen, and is now missing can't find at either residence.

It depends on the dollar amount of damage and theft taken at the burglary.
If they were arrested AT THE SCENE items WOULD NOT be missing since they had no way of leaving with the items.. That would be 3rd.

2 Degree's!

3 degrees - 1 degree = 2 degree's

You can't argue with the math!

My guess is "armed with a weapon", or "strong armed", no weapon.

Usually the law considers that a weapon often results in murder. The perpetrator will likely use the weapon if threatened.

No weapon, such as threats, is not likely to result in murder.
