Can you prove it was them
Have you had other partners

you gave consent for intercourse but not for getting herpes. Were you behaving responsibly-taking sensible precautions

I believe that it could constitute an assault-grevious assault /actual bodily harm

there have already been test cases concerning deliberate infection with HIV. Whether you gave consent to intercourse or not is not the problem. You did not give INFORMED CONSENT to have intercourse with a person who already knew that they were infected.

The same argument is applicable here
would you have agreed to have sex if you knew that the person had genital herpes-If the answer is yes then you gave informed consent-BY not knowing your consent is not valid in law as you were not able to make a choice.

They can be charged criminally...I am from Australia and we have had a number of individuals who have deliberately tried to infect people with HIV. Even if the sex is consensual that does not mean that someone deserves to get herpes of HIV. If a person knowingly and intentionally tries to infect someone with an STD or simply does not inform them that can be an offence. Especially in extreme cases where HIV is concerned.

All Australian states and territories also have criminal laws that can be applied if one person infects another with the HIV virus (or certain other blood born viruses or diseases). Depending on a range of factors, criminal transmission charges could include murder, attempted murder, manslaughter, common assualt, occasioning actual bodily harm, acting with intent to wound or inflict greveous bodily harm, negligently causing injury, causing grevious bodily disease and conduct recklessly endangering life.

this ? makes no sence...first of all there are 3 types of herpes and most people have one type or another or have had but if ur speaking of genital herpes....I guess u got off easy and didnt catch AIDS you are responsiable for your body.....sue yourself!

Absolutely not because you have allowed the person to play with you and the so your case will revoked. That is why it has been advised to not to play sex with every one. Sex is not the only hting left in our lives.
