Hershey's has milk in it, as do most major brands of dark chocolate.
But if you read the ingredients, spend a tad bit more money, you will find some vegan dark chocolate.
If you want good vegan chocolate of many styles - look for tropical source - vegan chocolate.

We have to look for brands that don't put dairy in them (why the hell do companies put dairy in dark chocolate? Doesn't that defeat the purpose?), but since there are plenty out there that make vegan dark chocolate, we sure can.
Tropical Source has a line of chocolate bars made on dedicated dairy-free machinery
Green & Black's dark chocolate varieties are vegan
Endangered Species dark chocolate varieties are vegan
Denman Island dark chocolate varieties are vegan
Sweet Earth Organic Chocolates has a line of vegan chocolates
Rose City Chocolatiers has a line of vegan chocolates
www.veganstore.com and www.veganessentials.com will also hook you up nicely with some vegan chocolate!

I love how all of the answers refer to what a vegan "can" or "can't" eat. A vegan or vegetarian can eat whatever they want. They simply choose not to eat certain things. It's not like there was some kind of government or cult that came together and decided what a person can or cannot eat. Example: I hate the "show" Big Bang Theory. By "show" I mean it's not actually a show, it's an abortion. I can watch it if I want to, but I refuse to support it in any way because it's not funny. So I choose not to. Vegans don't eat food made from dairy, so if the chocolate has milk, they don't eat it.

if it's vegan "chocolate" then yes.
I don't eat regular dark chocolate because there's dairy in it among other animal ingredients I'm sure.

Yes, as long as there are no dairy products in it at all. They can also eat soy chocolate (like milk chocolate, but made with soy milk) or carob, which is similar to chocolate.

The vegan chocolate really tastes like crap and it's astonishingly expensive in comparison. It is absolutely awful.
Making vegan products is a good business, slap "vegan" on it and you can up the price and the vegan crazies will pay through the nose for it. I know some people that make a fortune off of "vegan" products. This supports their gas guzzling boats, Hummers, wearing furs, and meat based diets. Kinda sad, it's like taking advantage of challenged individuals.
