My brother in-law has been in a relationship with a girl for about 4 months, she has Herpes.
My brother in-law sometimes shares his drinks with the kids, I think he believes he can only catch it if there is an outbreak. But my question is, IF he had it could he spread it to my kids?! I am talking about the STD herpes, not the mouth herpes.
He gave my children the drink before I even knew it.

In order to spread genital herpes a person has to have sex with that person or they need to have DIRECT skin to skin contact with that persons genital area.

Since your kids are simply just sharing a drink with your brother in law, then they can NOT get genital herpes from him.

If your brother in law has cold sores, then it's definitely a possibility he could spread the virus by sharing a drink with one of your children.

Genital herpes is almost always spread by sex (vaginal, oral, and anal) and by DIRECT skin to skin contact with the infected area.

I have had genital herpes for 6+ years, but I have NEVER had a cold sore in my life. I'll share drinks with my fiance and I'd share drinks back in high school with some friends. NONE of them ever contracted genital herpes from me by sharing a drink with me. It's impossible.
