I think the flaw in the story is already highlighted, as per the story, "sunday evening that culprit drank in the party gave by the district secreatry. On the way from the party that culprit saw the girl and he stopped the vehicle before the bungalow and he done all this rape, murder etc.,sir." But the incident happened at 2:00 PM that is much before the party that is "Sunday EVENING, so two do not connect, thus with my limited detective brain I am not I able to identify the culprit. Edit: So it is the inspector?

It is important to be able to forgive others and understand their position.
However, civilization as a whole cannot put this into practice, else civilization will fall. Law and punishment are necessary. After all, without law/morality, we would have no reason to call anyone a 'culprit' of anything.
Furthermore, not everyone who makes a mistake is repentant. These individuals will continue to harm others.
Since we cannot truly know or change anyone but the Self, we cannot necessarily tell the difference between someone who will change and someone who will not; thus, all must receive the same punishment.
I don't like it, but it is necessary for us to live together if we are all different.

Depends who is the culprit? Is it me or the other?also there is a quesstion how much power do I have?
If the culprit is me,I know I made a mistake then there is always room for improvement.
If the culprit is other then also its variable.For example, we always says that politicians are corrupted,but individually can we punish them?No! on the other hand, when we catch a thief who compares steal much less many corrupted people ,we punish the thief. Is in it unfair?That means we punish to only them on whom we can put on our power.
In conclusion,if there is a demon in you,upgrade yourself.If demon in other,the leave it upto God. Because no one wil slip away from the judgement day. :)

Your question is little bit philosophy than reality. Look to the real approach rather than ethical,spiritual aspect. Culprit is a criminal and there are different theories of punishments as you have also suggested.

If the culprit is wrong the victim himself is not always free of blame. I want a just punishment for myself as well as the culprit and God will grant it -no doubt.
I cant forgive a culprit who speaks against Krishna- NEVER. Let people point fingers , let I suffer but the one who said those things about Krishna -you read them too- Can you yourself forgive him??
