Over the 4th of July, I was at an amusement park. I had a very nice expensive phone in my pocket.

My mom convinced me not to take my purse (I shouldn't of listened to her!) but I ended up losing it at some point.

We called the phone all night. When the park was closing (Around 10 pm) I went to lost and found and put down my information.

We called the phone one last time, but realized that it was going straight to voice mail, this time.

So, obviously, someone had it and turned it off.

The next day, my mom received a text message on her phone (From my phone) with a number on it.

I called it and proceeded to talk to a lady....She claimed her kids had found it and she didn't realize they had it, until that day.

"I'm trying to do the right thing. I do have cingular, so I could have easily put my Sim card in it."

I thanked her for being honest.

She then asks about a finder's fee, which kind of caught me off guard.

I asked her what she thought was fair....

She laughed and said, "Well, ten thousand dollars."

Finally, she said $40.

Keep in mind, that in order for me to get the phone, it would require me driving two and a half hours...Not knowing what condition it's in or anything.

I'm just wondering what I should do? My mom's friend called her claiming to be our attorney...and told her to package and send the phone to her P.O box, which wouldn't cost any shipping fees.

The lady said she would, but it's been two and a half weeks.

Will claiming the phone as stolen to the Police in the City get me anywhere?

First off, it was considered stolen...because, the girl has admitted to having it and is obviously refusing to give it back to me without money.

That's ransoming.

It didn't cost her anything to take my phone!

I have personal pictures of my Military spouse on there. I'm also not rich and don't have tons of money...So, I never grew up spoiled.

what's wrong with doing the right thing? How hard is it for her to give me back my own phone?

Especially, when I've reasoned with her?

First of all, you are correct in your thinking. I would contact your local law enforcement and run the situation through them. Go to the station for this. If the woman if refusing to give you the phone, it now becomes a crime. She can't arbitrarily tell you she will "resell" you your phone. Bad move to lie about the attorney. She has no obligation to go package your phone and mail it. She does have a legal obligation to turn it over to you. Set up the meeting, stop by the local station where you willbe meeting theis person, and ask for a cop to assist you. Make sure you explain the ransom part. Or, meet the woman, get the phone in your hands, and leave. If she wants the money first, ask to see the phone,if she has it, call 911 and report the disturbance. Get her license plate number etc.Good luck.

I think you should have reported it stolen when this first happened, but since you didn't the police might not even listen to you or fill out a report (depending where you live) If you are able to file a police report give them the information that you have and let them know that you have the phone # of the lady and they should be able to trace the number, find the lady and get your phone back.

She sounds like a real B**** to me. I would call the lady back & agree to give her $40 or even $100. Then I would drive 2 1/2 hours to meet her.
From there you have two options:
(1) Beat her *** down.
(2) Have the cops with you when she shows up.

No. You know it was not stolen. You would be breaking the law by filing a false police report. Notify your service provider and have them put a block on the phone. In that way, it would be worthless to the woman who has it.

rererurugged gave you the right way of going about it.
Cut the phone off so that a pile of charges are not put on it.
Get another phone, try to be as careful as possible to not losing it, and let that highway-man woman have the rest of the shell, which will the phone after you call your service provider and cut it off from further use.

Yeah, it'll get ya arrested for filing a false report. She didn't steal it, you lost it. Quit whining, get a job, buy another phone. Just goes back to the old adage: "children should be seen and NOT heard!"
