Sounds like her card is handling my collection agency. They will try to get the full amount as much as possible. That's why they refused to accept a partial payment. They will harass until they get their money.

I would call Sears credit dept and verify the debt and explain what the collection agency is doing, then work with Sears on a payment plan

Are you sure you are dealing with "SEARS" or with the collection agency that they sold her debt to?
Collection agencies often want payment in full or they will negotiate for a 50% settlement.
I can't understand why they would refuse any payment even if it's partial.

Sears has a talent for doing everything it can to drive customers away. Their near predatory credit card practices are legend.
Tell your mom to order Sears to stop contacting her.

Sit down and tell him what you can pay, and see if they will work with you, most places will. If not, talk to your lawyer, or a probono lawyer, mine helped me get out of debit, by paying a small lumped sum, but in exchange I had to sign a paper saying I turned myself in to the police for nonpayment, and bad checks. I regret geting into that situation, its not somthing i'm proud of, but i've been good finacially ever since.

She needs to send her payment that she can afford in and always always take names of the people that she deals with even for the little things. She needs to send it in as a partial payment and state when she expects to make the next one. then follow through on that payment and stop using the card. She needs to log every call and who she talked to what their title was and so forth. So when they take her to court fo rthat small amount of money she can say that she called and talked to this person and they refused my partial payment. take pictures of the letter and send it registered mail to get proof of reciept. that way the judge can see that she tried and that they were being unreasonable and he will take their side when it comes to paying but she should countersue for the courtfees which she will win for her efforts of trying to pay. Big hassle but worth it. Good Luck

She should contact a debt consolidation agency. They are much better at negotiating with creditors than any of us. Tell them that if they continue to call and harass then your mom will be forced to file bankruptcy and they will get absolutely nothing.

They are allowed to call every day if they wish, despite what another poster claims. I highly doubt they've refused a payment either.
