Was in auto accident, my injuries aren't what theyare going by, they are going by condition of my car after I was rear ended instead, is this right? legal?

your collision will pay for the car. if you have injuries, the medical portion of your insurance should cover medical expenses, or the other driver's company should pay. if you were injured, you should have already sought medical care and have documented records showing the type and extent of injuries. keep all correspondence with the insurance company and submit COPIES of medical bills and documentation. if the insurance companies balk, get a lawyer.

the condition of your car and your condition are two separate things. Your insurance will pay your claim for your car under your collision and your medical under your med payment and/or liability if payment from the other company is not forthcoming. A rear ender means that you or your insurance company will need to sue the other drivers insurance company to recover all damages.
You should make the claim directly to the others insurance company first. If they don't pay up then you can go to your company.
